YOU ARE ENTERING A BINDING, WRITTEN LEGAL AGREEMENT THAT IS AS ENFORCEABLE AS A SIGNED, WRITTEN CONTRACT. You agree not to register an account with us, use the services, or access our websites or platforms for the purpose of market research, investigating potential legal claims, investigating consumer complaints, “secret shopping,” or for any reason other than for your own individual, preexisting business purposes related to your existing business. You warrant that you are not our business competitor, a government regulator, investigator, law enforcement officer, plaintiffs’ attorney, an employee/agent of the same, or anyone acting on behalf of the above.


Description of Service

National Bankcard operates a merchant processing referral service. We evaluate merchant applications and refer qualified businesses to third-party payment processors. We do not directly process payments or provide payment processing services.


Eligibility and Registration

User Eligibility

All of our offers are void where prohibited by law. To use this Website, you must:

  • We do not guarantee acceptance by any particular processing partner

Compliance with Rules and Servicer Guidelines

Your personal information provided through this site will be used to place you with a processing partner. You agree to comply with and be subject to all rules of Mastercard International, Inc. (“Mastercard”), Visa International (“VISA”), JCB International (“JCB”), Discover Network (“Discover Network”), American Express (“AXP”), and the National Automated Clearing House Association (“NACHA”), as they may exist from time to time and as applicable to your activities under any Merchant Processing Agreement, or any agreement with any of the above providers.

Opt-Out Rights

Opt-Out Processing

  • We will process opt-out requests as fast as our technology allows, but in no event later than within 10 business days

  • You may need to opt-out separately with any processing partners who contact you directly

Dispute Resolution & Class-Action Waiver

You agree that in the event of a legal dispute between you and us, you will submit the same only to binding arbitration under the then-current rules of the American Arbitration Association. You irrevocably waive your right to file a private lawsuit, participate in any class-action litigation or class arbitration, or to have a jury decide the case. You may opt-out of mandatory arbitration only if you do so in writing via certified mail and within 10 days of your first use of our website or services. This agreement shall be interpreted according to the laws of the State of New York, without regard to normal choice of law and conflict of law rules. The state and federal courts in New York shall have exclusive jurisdiction and venue over any litigation between the parties.


Limitation on Liability

In no event will our total liability to you, whether in tort, contract or otherwise, exceed the total amounts paid by you to us in the preceding 30 days. You agree to demand arbitration or otherwise make a legal claim against us, only within one (1) year following the first incident or event which gives rise to such claim.

In the event you qualify for merchant processing services through us or one of our banking/processing partners or affiliates, you may be required to agree to additional contract terms at that time.
