This Privacy Policy describes how National Bankcard (“we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with our merchant processing services. This policy applies to all personal information we collect from merchants, their customers, and other individuals in connection with our services.

WE RESPECT YOUR PRIVACY AND WE WILL NOT SELL OR SHARE YOUR INFORMATION EXCEPT AS AUTHORIZED BY YOU OR OTHERWISE ALLOWED OR REQUIRED BY LAW. WE UPDATE THIS POLICY AT LEAST ANNUALLY. This Privacy Policy expands upon and supersedes all prior versions and sets forth the data privacy practices of National Bankcard and applies solely to visitors and users (“consumers” or “you”) of our websites, including us and other online applications owned and operated by us. This policy does not apply to any third-party sites we may link to and we assume no responsibility or liability regarding the same. We adopt this policy to comply with the California Consumer Privacy Act of 2018 (“CCPA”), as amended, and other similar U.S. state data privacy laws, many of which are new.  These states include Alabama, California, Colorado, Connecticut, Delaware, District of Columbia, Indiana, Iowa, Kentucky, Maryland, Minnesota, Nebraska, New Hampshire, New Jersey, Oklahoma, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia.  No part of this policy may be construed or interpreted as creating legal obligations beyond what is clearly and strictly required by applicable law.

When you type your name, telephone number or email address into our website or otherwise submit the same to us, you agree that this shall act as your binding electronic signature and express written consent that we, along with our agents assigns, and listed partners that you select, may email, call and text you at the address(es) and number(s) provided (or provide later) with marketing offers and other information, including possibly using an automatic telephone dialing system, prerecorded messages and artificial/AI voices. Consent is not a condition of purchase as you can always email us directly instead. Message frequency varies over time and standard telephone and internet service provider rates apply and all conversations may be recorded and monitored. A. SALE AND SHARING OF PERSONAL INFORMATION

Sale of Personal Information: We do not sell personal information as defined by the California Consumer Privacy Act (CCPA).

Sharing for Cross-Context Behavioral Advertising: We do not share personal information for cross-context behavioral advertising purposes.

  • Provide proof of authorization which may include:
    • Power of attorney document
    • Signed permission letter with your signature

Additional Verification: We may require you to:

  • Confirm you provided the agent permission to submit the request

Business Representative Exception: If your agent is registered with the California Secretary of State to conduct business on your behalf, they may submit requests without signed authorization.

D. FINANCIAL INCENTIVE PROGRAMS

Current Programs: We do not currently offer financial incentive programs in exchange for personal information.

Future Programs: If we establish such programs, we will:

E. CALIFORNIA-SPECIFIC DEFINITIONS

“Sale” means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating personal information to a third party for monetary or other valuable consideration.

“Share” means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating personal information to a third party for cross-context behavioral advertising.

“Cross-context behavioral advertising” means the targeting of advertising based on personal information obtained from the consumer’s activity across businesses, websites, applications, or services.

“Sensitive Personal Information” includes:

  • Social Security, driver’s license, state ID, or passport numbers
  • Account log-in, financial account, debit/credit card numbers with access codes
  • Precise geolocation data
  • Racial or ethnic origin, religious or philosophical beliefs, union membership
  • Contents of mail, email, and text messages (unless we’re the intended recipient)
  • Genetic data, biometric information, health information
  • Sex life or sexual orientation information

13. ADDITIONAL STATE-SPECIFIC PRIVACY PROVISIONS

A. APPEALS PROCESS

In certain states, You have the right to appeal our decisions regarding your privacy rights requests.

B. UNIVERSAL OPT-OUT MECHANISMS

Ion jurisdictions where it is required, and as our technology allows: we automatically honor browser-based opt-out preference signals, including:

  • Global Privacy Control (GPC)
  • Do Not Track signals
  • Other recognized universal opt-out mechanisms

Automatic Processing: When we detect these signals from your browser, we will:

  • Stop sharing your personal information for targeted advertising
  • Opt you out of the sale of personal information (if applicable)
  • Apply the opt-out to all our services associated with your browser/device

C. BIOMETRIC DATA SPECIAL PROTECTIONS

We do not currently collect any biometric information, nor have we. In the event we do so in the future:

Illinois Residents (BIPA Compliance)

Written Consent Required: Before collecting biometric identifiers, we will:

  • Immediate destruction upon request or when no longer needed

D. ENHANCED STUDENT DATA PROTECTIONS

Iowa Residents Under 18: Additional protections apply to educational records and student data:

  • And in special situations, a signed declaration under penalty of perjury

15. FEDERAL PRIVACY COMPLIANCE

A. FINANCIAL DATA PROTECTION (NON-GLBA)

While we do not directly process payments or provide financial services, we maintain strict protections for any financial information collected during our merchant referral process:

  • Administrative, technical, and physical safeguards protect financial data
  • Limited access to financial information on a need-to-know basis
  • Secure transmission protocols for sharing data with processor partners
  • Regular security assessments and updates

Use Limitations

B. CHILDREN’S PRIVACY (COPPA)

We do not knowingly collect personal information from children under 13. Our services are designed for business owners who must be at least 18 years old. If we discover we have collected information from a minor, we will:

  • Terminate any associated account
  • Notify parents/guardians if contact information is available

C. MARKETING COMMUNICATIONS COMPLIANCE

When we collect and analyze information for merchant referral decisions:

E. THIRD-PARTY PROCESSOR COORDINATION

When referring merchants to processing partners:

Due Diligence

  • We verify that processing partners maintain appropriate privacy protections
  • Regular review of partner privacy and security practices
  • Contractual requirements for partner data protection

Information Sharing

  • Limited to information necessary for processing evaluation
  • Clear agreements on permitted uses of shared data
  • Notification to merchants about what information is shared and with whom

Ongoing Monitoring

  • Regular assessment of partner compliance with privacy commitments
  • Prompt investigation of any reported privacy issues
  • Termination of partnerships that fail to meet privacy standards

This federal compliance framework ensures your business maintains high privacy standards while operating in the merchant referral space, even without direct GLBA applicability.

New Jersey and West Virginia Public Service-Members

We value the privacy of public service members and do not intentionally publish or otherwise make available the information related to the same to the general public.  We typically do not collect any employment-related information related to the lead data we handle.  If you are or were a public service member in New Jersey or West Virginia specifically, including for example a current or retired New Jersey or West Virginia judge, prosecutor or police officer, do not submit any private, non-public contact information to us.  Regarding any information you provide to us, you agree that the same is public in nature and not confidential, sensitive or private.  You agree that, to the extent your non-public contact information is protected by New Jersey’s or West Virginia’s “Daniels law,” you will exercise your right to opt-out (a non-disclosure request) only by emailing your request to

info@nationalbankcard.com, and you will allow us a reasonable period of at least 30 days to recognize and honor your request.  You agree not to transmit such demands to us using an email address or other technique prone to result in some or all of your messages being automatically filtered into our email spam folder.  If you transmit your demand through any third-party privacy service, organization or platform, you agree to do so only through a pre-agreed upon VPN, download link, or as part of a periodic, consolidated list/spreadsheet from that third-party.
